What is foreclosure defense?

If you do not take any action regarding the foreclosure your mortgage company can have your house sold in as little as 4 or 5 months. Many of our clients wish to get a loan modification or a short sale. These processes can take months or years. The mortgage companies can continue with the foreclosure proceeding while they drag out the negotiations.

You have rights!

The State of Illinois guarantees you certain rights against the aggressive actions of the mortgage company. However, you want to have a lawyer in court defending your rights. You have probably read the articles in the news about mortgage companies filing false documents and forging affidavits. By engaging in foreclosure defense we can give you the time to seek alternative remedies. How much does foreclosure defense cost?

The cost is the equivalent of two mortgage payments. This is a small amount considering the cost of renting and the ability to stay in your home.

How quickly can the mortgage company sell my home?

It depends on where you are in the foreclosure proceeding.

  • If they have already sold your house we can usually keep you in your home for six months.
  • If you are in foreclosure but you have already missed the default date then we can usually keep you in your house for a year or more.
  • If you have just started to fall behind on your payments we have been able to give our clients up to 2.5 years.

Of course, we cannot give any guarantees. Every case is different and these period estimates are based on our prior successes. The state has given you certain rights as a homeowner.
